Ways of realizing invariant content in authentic texts of an international treaty in Russian, English, and French (the case of the Cartagena Protocol on Biosafety)

Abstract

The study aims to identify the cognitive mechanisms that ensure the preservation of an interlingual content invariant across the authentic texts of an international agreement in Russian, English, and French. The scientific novelty of the study lies in the first-ever demonstration of the cognitive nature of functional equivalence in a multilingual legal text. It is established that the identity of legal meaning is achieved not through formal structural correspondence but through the activation of universal image schemas rooted in sensorimotor experience of human interaction with the environment. For the first time, the prevailing models of metaphorical conceptualization are systematized using an authentic text of an international treaty representing ecological discourse, and patterns of lexico-grammatical asymmetry in the expression of deontic modality, voice, and temporality are identified. The results establish that lexico-grammatical structural asymmetry does not lead to a disruption of the document’s content invariant. It is proven that functional equivalence across the versions in three languages is achieved not through strict structural correspondence, but by activating cognitive models of experience categorization unique to each linguoculture.
